Contact Terms and Conditions

1. Purpose of Contact

  • The contact form is provided for inquiries, feedback, and communication related to our services.
  • It must not be used for spam, advertising, or unlawful purposes.

2. Accuracy of Information

  • You agree to provide accurate, complete, and truthful information when submitting a message.
  • Misrepresentation or false details may result in restricted access to our services.

3. Privacy and Data Protection

  • Information submitted through the contact form will be handled in accordance with our [Privacy Policy] and the Kenya Data Protection Act, 2019.
  • Personal data will only be used to respond to your inquiry and will not be shared with third parties without consent, except as required by law.
  • In line with Section 25 of the DPA, we commit to lawful, fair and transparent processing of personal data.
  • You have the right to access, correct and request deletion of your personal data as provided under Sections 26–30 of the DPA.

4. Data Retention

  • Contact form submissions will be retained only for as long as necessary to fulfil the purpose of communication, in compliance with Section 39 of the DPA.
  • After this period, data will be securely deleted or anonymized.

5. Role of the Data Commissioner

  • The Office of the Data Protection Commissioner (ODPC) is the regulatory authority established under Part III of the DPA.
  • The Data Commissioner oversees compliance with the Act, including monitoring, investigating and enforcing data protection obligations.
  • If you believe your data rights have been infringed, you may lodge a complaint with the Data Commissioner in accordance with Section 56 of the DPA.
  • We cooperate fully with the ODPC in fulfilling our legal obligations and ensuring accountability in data handling.

6. User Consent

  • By submitting information through the contact form, you explicitly consent to the collection, processing, and storage of your personal data for the purposes stated in these Terms and Conditions.
  • Consent is obtained in line with Section 32 of the DPA, which requires that consent be informed, specific and freely given.
  • You may withdraw your consent at any time by contacting us, and upon withdrawal, we will cease processing your data unless required by law.
  • Withdrawal of consent does not affect the lawfulness of processing carried out prior to withdrawal.

7. Intellectual Property

  • Messages must not contain copyrighted material, offensive content, or material that infringes on the rights of others.
  • By submitting content, you grant us a non-exclusive right to use the information for the purpose of responding to your inquiry.

8. Limitation of Liability

  • We are not liable for delays, technical errors or non-delivery of messages due to internet or system failures.
  • Responses provided are for informational purposes only and do not constitute binding commitments unless expressly stated.

9. Governing Law

  • These Terms and Conditions are governed by the laws of Kenya, including the Data Protection Act, 2019.
  • Any disputes arising from use of the contact form will be subject to the jurisdiction of Kenyan courts.

10. Amendments
